Unless otherwise specified, price quotes are good for 30 days. Prices and specifications are subject to change without prior notice. Full payment is due upon delivery or in accordance with pre-established credit terms. Ownership Title shall pass to customer only after receipt of full payment for all equipment, software and services purchased. However, risk of loss is transferred to customer as of the date of delivery.
II - Returns
All returns need a RMA number and cannot be accepted after 10 days of delivery. No returns are accepted on special orders or drives, memory, CPU chips or open software. All returns must be complete, and in original packaging, and in a re-salable condition, and are subject to restocking fees.
III - Warranty
All products supplied by NetCom Systems are warranted by their respective manufacturer or publisher for a period of at-least one year. All warranties are the manufacturer or publisher warranties, NetCom Systems does not extend any other warranties of it's own. NetCom Systems will handle all warranties for the first year from date of purchase. When service is required after the first year, NetCom Systems will represent the client in dealing with the manufacturer, however, client is responsible for all costs involved including packaging, delivering and shipping the products back and forth. Warranty service is limited to repair or replacement, at our option, of defective items with new items or equivalent to new in performance. The warranty is limited to, and in no manner shall exceed the original purchase price paid to NetCom Systems. All warranties will be voided if services are performed on the equipment by anyone other than NetCom Systems personnel.
Non coverage: Not covered by any warranty are failures or defects resulting from war, civil riots, theft, vandalism, power variations, interruptions and fluctuations, improper storage, misuse, mishandling, or any act of God. Software installations, setups and configurations are not covered by any warranties and are the sole responsibility of the client.
IV - Requirements
In accordance with manufacturers requirements and specifications NetCom Systems advises of the following:
Failure to comply with any of the above requirements will void all warranties and relieves NetCom Systems from all liabilities.
V - Limitation of Liability
NetCom Systems makes no representations or warranties of merchantability or fitness for any particular purpose. NetCom Systems is no way responsible for any damages or loss of profits resulting from data loss, or loss of use of the equipment or software, due to hardware or software failures or defects, or errors or omissions on our part, even if we were advised of the probability of such damages. NetCom Systems shall not be held to any liability with respect to any claim by client or third party on account of, or arising from the use of: software, hardware, documentation, service, or advice. Furthermore, NetCom Systems shall not be liable for any incidental or consequential damages related to such a claim.
VI - Services
NetCom Systems' services are performed with the utmost professional care and attention, however, NetCom Systems cannot and does not assume any liability for any data or information lost or otherwise irretrievable as a result of our services. Clients requesting service agree to assume complete responsibility for any data or information which might become lost or irretrievable as a result of the requested service. Clients are hereby advised to have their data and programs fully backed up prior to requesting service. In the event that the client requests NetCom Systems to perform the backup, NetCom Systems assumes no responsibility for the comprehensiveness or integrity of the backup.
VII - General
All NetCom Systems sales and services are governed by these Terms and Conditions which are subject to change without prior notice. Any errors and omissions contained herein or in any document presented by NetCom Systems shall be subject to correction and change. Any use of products or services provided by NetCom Systems constitutes client's understanding and acceptance of all the above terms and conditions.
